The terms covering this website and the New Day AI voice assistant service.
Who you are agreeing with
New Day AI is a service of New Day Creative, of Mansfield, Ohio. “We” and “us” mean New Day Creative. “You” means the business engaging us, and the people it authorises to use the dashboard.
Using this website
This site is information about a service. Nothing on it is an offer or a binding quote — pricing and timelines are agreed in a written proposal after an assessment. Don’t attempt to disrupt or gain unauthorised access to it.
What the service is
A voice assistant that answers a phone line you route to us, speaks to a script agreed with you, books appointments into your calendar, routes callers according to your rules, and sends confirmations and reminders. Engagements normally run: an assessment, a build and deployment, then an ongoing account.
What it does not do
These are real limits of the built system, not disclaimers. We would rather you read them here than discover them on a live call.
- It moves the time of an appointment, not the person. Changing who a customer sees is a cancellation and a new booking.
- It books services you have defined, including combinations you have set up. It will not invent an arbitrary pairing of two services; it declines and offers to take a message.
- Cancellations are confirmed by email, not by text. That message type is not registered on our messaging campaign.
- It does not take payments or deposits.
- It can mishear. Names and email addresses are spoken aloud and have no built-in error checking. The assistant reads them back, and your booking notification marks an email address as transcribed from speech, but you remain the check on it.
- Setup is not instant. Registering a number for business text messaging takes roughly two to three weeks and is controlled by the mobile carriers, not by us.
Your responsibilities
- Give us accurate information — services, durations, staff, availability and rules. The assistant is only as correct as the catalogue behind it.
- Keep your own records. Your calendar remains your system of record.
- Use the service lawfully, and tell your customers what you need to tell them.
- Keep dashboard access to people you have authorised, and tell us when someone should lose it.
Availability
We depend on telephone carriers, calendar and messaging providers and cloud infrastructure we do not control. We do not guarantee uninterrupted service, and message delivery is never guaranteed — carriers are not obliged to deliver, and a message can be delayed or dropped without either of us being told.
You can have the line handed back to you at any time; this is the first thing to do if something is wrong and it turns an emergency into an inconvenience.
Fees
Fees, what they include, and any usage allowances are set out in your proposal. Invoices are payable as stated there. Where usage exceeds an allowance, we will tell you before charging for it.
Term and ending it
Either of us may end an ongoing engagement on the notice in your proposal. On termination we stop answering your line, you keep everything already written into your calendar and systems, and we will provide an export of your call records on request. We may suspend the service for non-payment or for use that puts our messaging registration at risk, and we will tell you before we do.
Who owns what
We keep ownership of our platform, scripts, workflows and tooling. You keep ownership of your business information, your customer data and your appointments. We handle your customers’ information on your behalf and on your instructions — see the privacy policy.
Liability
We provide the service with reasonable skill and care. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profit or lost business, or for messages a carrier fails to deliver, and our total liability is limited to the fees you paid us in the twelve months before the claim. Nothing here excludes liability that cannot lawfully be excluded.
Governing law
These terms are governed by the laws of the State of Ohio, and the courts of Richland County, Ohio have exclusive jurisdiction.
Changes
We may update these terms and will post the revised date above. Where a change materially affects an active engagement, we will tell you directly.
